The Over30Experiences Terms of Service (“Terms”) is a legal agreement between you and Shadow Concepts LLC, d/b/a Over30Experiences and Under30Experiences("Over30Experiences" “Under30Experiences,” “we,” “us,” or “our”) that governs your interaction on Over30Experiences.com (the “Site”) and your purchases and use of products and services made available through the Site. The term “you” refers to the customer visiting the Site and/or booking a reservation through us on the Site or through our service providers. By accessing or using the Site, making any reservation on the Site, or contacting any of our service providers to make a reservation, you agree that the Terms then in force shall apply. If you do not agree to the Terms, please do not use or book any reservations through the Site or our service providers. We have the right to change the Terms at any time without notice, effective upon its posting to our Over30Experiences website. Your continued use of Over30Experiences shall be considered your acceptance to the revised Terms.
Use of the Site
As a condition to using the Site, you warrant and agree that:
We retain the right, in our sole discretion, to deny you access to the Site, at any time and for any reason, including, but not limited to, for violating these Terms.
The content and information on the Site (including, but not limited to, price and availability of travel services) as well as the infrastructure used to provide such content and information, is proprietary to us. While you may make limited use of travel itinerary and related documents for travel or service reservations booked through the Site, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through the Site. LINKS TO THIRD-PARTY SITES
The Site may contain hyperlinks to websites operated by parties other than Over30Experiences. Such hyperlinks are provided for your reference only. We do not control such websites and are not responsible for their contents or the privacy or other practices of such websites. Further, it is up to you to take precautions to ensure that whatever links you select or software you download (whether from this Site or other websites) is free of such items as viruses, worms, trojan horses, defects and other items of a destructive nature. Our inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with their operators.
SERVICE PROVIDER TERMS
Service providers may require you to agree to additional terms and conditions in connection with the products and services you purchase from them. Please read all additional terms and conditions carefully. You agree to abide by all additional terms and restrictions, including without limitation, availability, age and occupancy requirements, pet policies, policies on children, fares and other restrictions. You agree that any violation of any such terms and/or restrictions may result in cancellation of your reservation, forfeiture of costs and expenses in connection with your reservation, and being charged by Over30Experiences for any costs we incur as a result of such violation.
I understand and acknowledge that Over30Experiences does not represent or act as an agent for, and cannot control the acts or omissions of, any host institution, host family, transportation carrier, hotel, tour organizer, or other provider of good or services.
I understand and acknowledge that Over30Experiences assumes no responsibility or liability, in whole or in part, for: any delayed or changed departure or arrival times; fare changes, dishonors of hotel, airline, or vehicle rental reservation, missed carrier connections; sickness, disease, injuries (including death), losses, damages, weather, strikes, acts of God, circumstances beyond the control of Over30Experiences, force majeure, war, quarantine, civil unrest, kidnapping, public health risks, criminal activity, terrorism, expense, accident, injuries, or damage to and lost property; bankruptcies of airlines or other service providers; inconveniences, cessation of operations, mechanical defects, failure or negligence of any nature whatsoever caused in connection with any accommodations, restaurant, transportation, or other service or for any substitution of hotels or of common carriers beyond Over30Experiences control, with or without notice; or for any additional expense occasioned by any of the foregoing. If due to weather, flight schedules, or other uncontrollable factors, I am required to spend additional nights in the Destination or another location, Over30Experiences will not be responsible for my hotel, transfers, meal costs, or other expenses. My baggage and personal property are transported entirely at my risk.
The purchases made through Over30Experiences do not include incidental expenses, except as specifically described in your itinerary, and you are liable for all such incidental expenses that you incur during, or in anticipation of, your purchased product and/or service. These things may include but are not limited to: airfare to the destination, lunches, incidental expenses, alcohol, and any entrance or departure fees into the destination country.
You agree and acknowledge that in order to participate in any Digital Nomad Trips travel insurance is required. The insurance that you obtain must adequately cover you for medical expenses, accidents, property loss, and curtailment or cancellation of your trip. Such insurance is not included with your purchase on the Site. Proof of insurance will be required prior to departure and lack thereof will result in cancellation of participation in Over30Experiences.
It is mandatory that all attendees obtain travel insurance with a minimum coverage of $200,000 USD while traveling with Over30Experiences. Such insurance must cover personal injury, medical expenses, loss of or damage to luggage, repatriation expenses, and evacuation expenses.
TRAVELER SAFETY / EXPULSION
Over30Experiences and Service providers from which you purchase products and/or services reserve the right, in their absolute discretion, to expel attendees whose statements, acts, or omissions threaten the safety of themselves or others, or disrupt the trip in any way. Expelled attendees will not be entitled to a refund, will be responsible for any costs they must incur as a result of such expulsion, including without limitation, replacement accommodations and return travel, and may be subject to liability for any harm or damages arising out of their statements, acts, or omissions. You agree and acknowledge that Over30Experiences and Service providers are under no legal duty to expel attendees and are not responsible for the conduct of attendees. You acknowledge that you will be billed for any damage to hotels and will be held responsible for your actions. I agree to the "General Rules" listed on the Trip Details page of the trip you are purchasing.
Over30Experiences either owns, or has licensed, all U.S. legal right, title and interest in and to Over30Experiences, including but not limited to, any trademark, copyright, patent, trade secret, trade dress, service marks and other worldwide intellectual property rights as they relate to Over30Experiences (the “Intellectual Property”). These Terms do not grant you any rights with respect to the Intellectual Property.
The information, software, products and services published on the Site may include inaccuracies or errors, including pricing errors. In particular, we do not guarantee the accuracy of, and disclaim all liability for any errors or other inaccuracies relating to the information and description of the hotel and other travel products and services displayed on the Site (including, without limitation, the pricing, photographs, list of hotel amenities, general product descriptions, etc.). In addition, we expressly reserve the right to correct any pricing errors on the Site and/or pending reservations made under an incorrect price.
In no event shall we be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use of this Site or with the delay or inability to access, display or use the Site (including, but not limited to, any computer viruses, information, software, linked sites, products and services obtained through this Site; or otherwise arising out of the access to, display of or use of the Site) whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if we have been advised of the possibility of such damages.
If, despite the limitation above, we are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then our liability will in no event exceed, in the aggregate, the greater of (a) the service fees you paid to us in connection with such transaction(s) on the Site, or (b) One-Hundred Dollars (US$100.00) or the equivalent in local currency.
The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose.
RISKS AND INDEMNITY
You acknowledge and agree that participation in activities, such as adventure travel, involves inherent risks and dangers of accidents, personal and bodily injury (including death) and property loss or damage. You agree that you have considered the nature and extent of the risks involved and voluntarily choose to assume all such risks, both known and unknown, even those risks that result from the negligence of others and assume full responsibility for your participation in such activities.
You agree to indemnify, defend, and hold harmless Over30Experiences, its affiliates, officers, directors, employees, agents, services providers and licensors from and against all losses, liabilities, costs (including, without limitation, attorneys’ fees and costs on appeal or at trial), damages, judgments, claims, of every kind and nature, to the fullest extent permitted by law, arising from or relating in any way to (i) your use of the Site, (ii) products or services you have purchased through the Site, (iii) your breach of these Terms or the documents referenced herein, or (iv) your violation of any law or the rights of any third party.
All trip schedules and activities are subject to change before and during the trip.
NOTICE OF INFRINGING MATERIAL
If you believe in good faith that materials hosted by us infringe your copyright, you (or your agent) may send us a written notice that includes the following information. Please note that we will not process your complaint if it is not properly filled out or is incomplete. Any misrepresentations in your notice regarding whether content or activity is infringing may expose you to liability for damages.

Applicable to all Under30Experiences, Over30Experiences, and Digital Nomad Trips.
Life can throw unexpected things at all of us and can disrupt the best-laid plans. For that reason, we have a very flexible transfer policy for our travelers to take advantage of.
Simply email us with at least 30 or 60 days' notice (depending on the trip) for all departures, and you can switch your trip one time for free or place your Experience Credits on hold. You can find a trip-specific policy on the “Trip Details” page. Kindly be aware that cancelations are not accepted via WhatsApp or other social media platforms.

If you can't commit to another trip date right now, don’t worry! When you're able to make time for another trip, just let us know what trip you’d like to use your credits for. Please understand, your credits are only transferable to another departure one time, after that the credits are forfeited.
*Please note that some trips have non-refundable permits that we secure on your behalf. In these cases, the cost of the permit is nontransferrable at the time of purchase. Please review the "Trip Details” page of any trip you are looking at for its specific terms.*
*Coupon codes and/or promotional prices are not transferable. When transferring to a different trip you will be responsible for any difference in price.*
24-Hour Booking Guarantee
The Experiences Company provides a no-questions-asked full refund of your purchase if the request is made within 24 hours of your booking. So go ahead, jump on that deal now, and ask questions (to your boss) later!
Experience Credits are Giftable
Can't travel with us for the foreseeable future? You can give the gift of travel to your friends and family. Experience Credits are 100% transferable!
Please note that only Experience Credits equivalent to the value of your original payment are transferable. Earned Experience Credits are non-transferrable in all forms. Earned Experience Credits can include but are not limited to our referral program, community programs, contests, events, customer service, and any other form of rewards.
*Gifted credits are non-refundable even in the event that we cancel the departure. Any departure booked with gifted credits can be canceled and transferred to another departure one-time. After that, the credits are forfeited.*
Emergency Cancellation within 30 or 60 days:
To cancel a trip that is not within our cancelation period, please refer to your travel insurance policy.
If you need to cancel your trip due to a last-minute emergency, your travel insurance may cover reimbursement. You'll need to consult directly with your travel insurance company for specific details.
We are not able to transfer or hold any credits that are not within the cancelation period of 30 or 60 days before your trip, depending on the cancelation policy of the trip.
Forced Trip Suspension Policy
When we are forced to cancel a trip, due to situations outside of our control, we are unable to issue refunds. In this case, we will offer travelers 100% credit of the price paid for the trip, valid for use toward any future trip.
A “force majure” event includes but is not limited to natural disasters, political unrest, and pandemics. We only cancel trips when there are major disruptions to our itineraries, and/or when local authorities, or when the US Department of State issues a "Level 4 Do Not Travel Warning” to a country.
Your Experience Credits never expire, have no blackout dates, and are transferable to a friend or family member.
Please understand that when you book a trip with us, your money goes directly to vendors abroad, who do not offer refunds in these cases. The money is held with them to be used for future travelers, thus, we cannot provide refunds.
Other Cancellation Notes:
You are strongly advised to take out cancellation insurance at the time of booking. If you do not participate in the trip, join it after it has started, or choose to leave before it concludes, you will not receive reimbursement. This includes missed flights, delays, injury, illness, and quarantine due to infectious disease during the trip. In these cases, please consult your travel insurance company to cover expenses.
If you put a deposit down on a trip, and do not pay in full by the required date, your trip will be forfeited and no credits will be issued, unless you email us to put your credits on hold or transfer to another trip.

The Under30Experiences mobile message service (the "Service") is operated by Under30Experiences (“Under30Experiences”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Under30Experiences’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Under30Experiences through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Under30Experiences. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt out of the Service at any time. Text the single keyword command STOP to +18335531537 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device unless initiated by you. If you have subscribed to other Under30Experiences mobile message programs and wish to cancel, except where applicable law requires otherwise, you must opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any shortcode or telephone number to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests you send to a short code or telephone number we have changed, may not be received, and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you must sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
